These Terms of Use govern your access to and use of the Global Tableware Collective (“GTC,” “we,” “our,” or “us”) website, services, and digital platforms. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Eligibility and Account Requirements
1.1 Age Requirements
The Services are intended for adult users. You must be at least 18 years of age to create an account, place an order, or use the Services in any way that involves transactions, data entry, or persistent account features.
Individuals under 18 may view the website and may create a limited viewer account for browsing, provided they supply a valid email address. GTC does not collect age information and does not verify user age. You are solely responsible for ensuring that you are legally permitted to access and use the Services in your jurisdiction.
1.2 Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to be solely responsible for all use of the Services and any related documentation under your account and, where applicable, within your organization.
You agree not to allow individuals without proper permission to access or use your account, including placing orders on behalf of your company without authorization. You are responsible for controlling access to your lists, shared content, and any information stored within your account.
You agree to use commercially reasonable efforts to prevent unauthorized access to or use of the Services and to notify GTC promptly of any such unauthorized access or use. You are solely responsible for all acts and omissions of users who access the Services using your account, whether or not such use was authorized by you.
2. Permitted Use of the Services
The Services are intended solely for viewing and evaluating products, creating, storing, and sharing product lists, and ordering samples or related items where available. Any use of the Services outside of these intended purposes is considered an unintended use and is not permitted under these Terms.
Public list sharing is allowed. Lists designated as public or shared via a link may be accessible to anyone with the link. You are responsible for any information you choose to include in a public or shared list and for ensuring the appropriate level of confidentiality and access control.
You agree that you will not:
• Scrape, harvest, or systematically extract data, product information, images, or other digital assets from the Services without prior written permission from GTC.
• Use bots, crawlers, automated scripts, or similar tools to interact with the Services, except as explicitly authorized by GTC in writing.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from any part of the Services.
• Circumvent or attempt to circumvent any access restrictions, security mechanisms, or rate limits associated with the Services.
• Use the Services in any manner that infringes, misappropriates, or violates any third-party rights or applicable laws.
3. Orders, Fulfillment, and Address Requirements
All orders placed through the Services must contain complete, accurate, and valid information. You agree that:
• All orders must include a valid shipping address and contact details.
• Orders are subject to validation and verification, including address and payment checks where applicable.
• GTC may cancel, reject, or place on hold any order that fails validation, contains material errors, appears
suspicious, or otherwise raises reasonable concerns about misuse or fraud.
• GTC may review order history and associated account behavior and may suspend or terminate accounts engaged in
fraudulent, abusive, or misleading ordering practices.
GTC employees may contact you using the information provided through the Services to verify orders, request clarification, or coordinate shipment and delivery details.
4. Third-Party Service Providers
By creating an account or placing an order, you consent to GTC sharing your email address with SendGrid, our third-party email provider, solely for the purpose of sending account-related and transactional communications, such as verification emails, password reset messages, order confirmations, and updates.
GTC employees may also use the contact information you provide (such as your email address or phone number) to communicate with you regarding orders, account issues, or inquiries.
We do not authorize SendGrid or other third-party providers to use your data for independent marketing or any purpose unrelated to the operation of the Services.
5. Suspension, Termination, and Deletion of Data
5.1 Suspension of Service
GTC reserves the right to suspend, restrict, or limit access to any account or to the Services generally, at any time and in its sole discretion, if we believe that:
• The account is misusing the Services.
• The account has violated these Terms.
• The account presents a security or fraud risk.
• The account is associated with invalid, abusive, or misleading ordering behavior.
5.2 Deletion of Data
GTC retains the right to delete any account or data associated with an account if we determine that these Terms have not been met, that the account has been misused, or that continued retention of such data is not in our business, legal, or security interests.
You may request deletion of your account and associated personal information, subject to our legal and operational retention requirements. Certain data, such as transaction records, may be retained as required by law, for audit purposes, or for legitimate business needs.
6. Ownership and Intellectual Property
GTC owns all rights, title, and interest in and to the Services, including the website, underlying code, databases, designs, layouts, content, product data, and other digital assets, as well as any GTC trademarks, logos, and branding displayed on or through the Services.
Certain components of the Services, such as open-source libraries or icon sets (including, for example, Bootstrap Icons), are used under their respective third-party licenses. GTC does not claim ownership of such third-party materials but retains all rights to its own proprietary content, code, and digital assets.
Except as expressly permitted in writing by GTC, you may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the Services.
7. Warranty Disclaimer
The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, GTC expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
GTC does not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any information provided through the Services is accurate, complete, or up-to-date. Your use of the Services is at your sole risk.
8. Limitation of Liability
To the maximum extent permitted by applicable law, GTC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or other intangible losses, arising out of or in connection with your access to or use of the Services, even if GTC has been advised of the possibility of such damages.
GTC shall not be liable for any damages arising from service outages, interruptions, delays, order processing errors, inaccuracies in product data, unauthorized access to or use of your account, or any reliance you place on information obtained through the Services.
In no event shall GTC’s total aggregate liability for all claims arising out of or relating to the Services exceed the amount actually paid by you to GTC for the order giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, these limitations apply only to the extent permitted by law.
9. Optional Arbitration
Users may elect to resolve disputes with GTC through binding arbitration under the rules of a mutually agreed arbitration organization. Arbitration is optional and not mandatory. You retain the right to bring claims in a court of competent jurisdiction if you do not wish to arbitrate a dispute.
Nothing in this section limits GTC’s ability to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to address unauthorized use of the Services.
10. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to the Services are governed by the laws of the United States and, without regard to conflict-of-law principles, the laws of the State of Ohio, where GTC maintains operations. GTC also operates in Pennsylvania, and certain activities or shipments may additionally be subject to applicable Pennsylvania law.
Shipments delivered to other states or countries are subject to the local laws and regulations of their destination jurisdictions, particularly regarding import, customs, and delivery.
You agree to submit to the personal jurisdiction of the state and federal courts located in Ohio for any dispute not resolved through arbitration and arising out of or relating to these Terms or your use of the Services.
11. Changes to These Terms
GTC reserves the right to update or modify these Terms at any time, with or without prior notice. When changes are made, the “Last Updated” date at the top of this page will be revised. Your continued use of the Services after any such changes become effective constitutes your acceptance of the updated Terms.
